Mt. Nebo Junior High School Policies

Attendance

You are expected to attend each class, on time, every day. School attendance has a direct impact on academic achievement. If you cannot attend school because of illness, medical appointment, a funeral, etc., the absence must be explained by a telephone call (attendance line is 465-6033, 7 days a week, 24 hours a day) or a note from a parent. If you need to leave school during the school day, you must bring a not from a parent or call home and have your parent talk to the attendance secretary before you may be properly excused and checked out.

Building Hours

You may enter the school building at 7:00 a.m. on school days. Students are expected to be out of the school building by 2:30 p.m. after school is dismissed, unless you are under the direct supervision of a teacher. This should give students ample time to take care of necessary school business before and after school.

Bicycles

If you wish to ride a bicycle to school, you should have a good lock for it. Once you arrive at school, you should lock it in the fenced bicycle area. This area will remain locked during school hours, and if you need your bicycle before the end of seventh period, ask someone in the office to unlock the gate. Do not ride your bicycle between cars or buses.

Roller Blades/Skateboards

You may not ride skateboards or roller blades on school property.

Books

The textbooks and library books you will use are the property of Nebo School District. If they are lost or damaged, you must pay for their replacement or repair.

Bus

Riding the bus is a privilege offered only to those students who have been scheduled to do so by the Nebo District Transportation Department. Improper conduct could result in that privilege being denied. It is important to board the bus promptly after school. In order to meet their schedules, buses depart just 7 minutes after school is out.

Counselors

We have three wonderful counselors to assist our students. Mrs. Marker, Ms. Crane and Mr. Hiatt are available by appointment. To meet with one of them, please speack to the counseling secretary, and she will arrange it.

Closed Campus

Because Mt. Nebo Junior High School is a closed campus, once you arrive at school, you must remain at school until dismissed at 2:21 or until you have been signed out at the office by your parent. You may check out of school at the front office by showing a note from your parent or by having an adult in the front office speak to your parent on the phone.

Hall Etiquette

Students are not to be in the hall during class time. If it is necesary for you to be out of class, you are required to carry a wooden hall pass issued by your teacher. In between classes students should walk, not run on the right side of the hall. Due to crowding in the hallways between classes students are asked not to stand and visit in large groups, making it difficult for others to pass by. Students are reminded that you should be in your seat in class when the tardy bell rings.

Wall of Fame

Each term students who achieve a GPA (Grade Point Average) of 4.0 will be recognized by having their names posted in the main hall. Students with a GPA of 3.75-3.99 will also be listed as "High Honors" and students with a GPA of 3.5-3.74 will be listed as "Honors".

Lockers

It is your responsibility to keep your locker clean and undamaged. No stickers or decals, please. School materials not needed for your current class should be stored there. You may not change lockers without permission from the office. You must never open another student's locker. Keep your locker combination private. Lockers will be checked from time to time. You will be responsible for its repair. Please do not bring large amounts of money, valuables, or expensive items to school. If a special circumstance arises, or you have any problems with your locker please report to the office where help can be found.

Make Up Work

You are expected to make up work missed because of absences. You should contact the teacher as soon as you return to school to find out what you have missed and how to complete the assignment you missed. If you will be absent for several days, you or your parent are are encouraged to contact the school and make arrangements to collect the assignments you are missing so you will not fall behind in your classes.

Lost and Found

The lost and found is located in the cafeteria, however items of greater value, (i.e.: watches, calculators, jewelry, wallets) are taken to the front office.

Media Center

The Media Center offers a wide range of fiction and non-fiction books for students to check out. It is open between the hours of 7:20 a.m. to 2:50 p.m. Students may check-out a maximum of three books at a time for a two-week period with a two-week renewal period. There is a .10 a day fine for overdue books. (See Media Center Section on this web site for more information).

Nebo School District Non-Discrimination Policy

"It is the policy of the Nebo School District not to discriminate on the basis of sex, race, color, national origin, religious creed or handicap in its educational programs, activities, admissions, access, treatment or employment practices" and any person or student who feels a need to challenge the district's adherence to the policy may do so by directing their concern to the principal or departmental director, then if not satisfied, to the district complicance officer. This is the Human Resources Director at 350 South Main Street, Spanish Fork, Utah. Call 801-354-7400 for information or an appointment.

Americans With Disabilities Act

In compliance with the Americans with Disabilities Act , qualified individuals needing reasonable accommodations (including communication aids and services) should contact the principal of this school or the Nebo School District ADA Coordinator, Mr. Cary Bailey, 354-7440 or Utah Relay System at 1-800-364-4128. Please inform us of your needs at least three days prior to the activity.

General School Guidelines

A. Each student is expected to show courtesy and respect and to follow the directions of those in charge. Appropriate behavior will be expected in the classroom, hallway, and on the school grounds. Hand-holding and public display of affection are not permitted on school property.

B. As a sign of respect, all faculty and staff members are to addressed as Miss, Mrs., Ms. or Mr. and in no case by just their first or last name.

C. Students are expected to be careful of all school property and in no way mar or disfigure it. Any student defacing school property will be held personally liable for its repair or replacement.

D. Students are not to have possession of any tobacco, products, alcohol, or drugs while at school as described in the Nebo District Drug, Alcohol, and Tobacco Policy. (See Student Use of Tobacco, Alcohol and Other Drugs Policy)

E. Students are expected to keep the school grounds, rooms, and halls free from paper and other garbage. Waste baskets and trash cans are to be used for this purpose.

F. No lunches or drinks are allowed in the halls or classrooms.

G. Nuisance items and/or toys which includes, but is not limited to: radio/CD players, balloons, yo yo's, laser pens, do not belong in school. Items which detract from the educational climate of the school do not belong in the building. Students are to leave these items at home. Nusiance items will be confiscated and not returned to students. Students are responsible for the safekeeping of all personal belongings.

H. Skateboards, rollerblades, scooters, roller shoes, etc., may damage school lockers and property and do not belong at school. If these items are brought to school, they may be confiscated and not given back to students.

I. Students from outside the school area visiting with relatives will not be allowed to attend school as guests, according to district guidelines.

J. Students are expected to adhere to all Nebo School District policies including: Student Dress and Grooming Standards, Closed Campus Policy, Attendance and Citizenship Policy, Safe School Policy, and Sexual Harassment Policy.

K. The school administration and/or student council may establish additional rules and guidelines for the benefit of all.

L. No pagers or cellular phone will be allowed at school.

M. Lost and found items can be found in the lunchroom or office. Students should label all valuables to assist in their return. All lost items will be donated to a charity if not claim by the end of the school year.

N. Backpack Policy: Backpacks or book bags are welcome at school, but should be kept in the students locker and not taken to class.

O. Administrative Action(s): This handbook is not intended to be all inclusive, but contains information relevant to the safe and orderly operation of the school at the time of printing. The school administration reserves the right to make additional policies and make decisions as deemed appropriate. Appeals of administrative decisions must follow Nebo School District Policy #KLD.

Directory Information

The following items are designated as Directory Information: Student name, address, telephone number, date and place of birth, participation in officially recognized activities and sports, dates of attendance at school, awards and honors received, the most recent educaitonal agency or institution attended by the student, grade level, and the student's photograph as published in the school yearbook. The school may disclose any of this information without prior written consent unless notified in writing to to contrary by September 1st of each school year.

Discipline Policy

We, as the faculty and staff of the Mt. Nebo Junior High School, are proud of the students who attend our school. The majority of our students are conscientious and well-behaved. It is our goal to promote a positive educational experience for our students. We believe in giving students the freedom to make choices, but the consequences for their choices are determined by school policy. We reward good behavior with drawings, assemblies, student of the month, and self-esteem programs. Each teacher will have and make use of a classroom discipline plan.

Tardy Policy

The Phone Master system calls the home of each student who is tardy any period during the school day. A 30 minute detention must be served within 5 days of the tardy after school in Room 235 for each tardy.

Absences

Parents are to call the school (465-6033) to excuse students when they are absent. This number can be called anytime, during any part of the day or night. They should be specific when stating the reason, i.e.: illness, doctor, dentist, excused, etc. All absences must be cleared within two days from the day of the absence.

Student Appearance

Student Dress and Grooming Standards

The student dress guidelines are meant to help maintain a positive learning environment. Because certain fads and extremes of dress and hair styling tend to attract improper attention to the individual and sometimes interfere with the normal educational process, all students are expected to conform to the standards of dress and grooming outlined below when participating in any school activity. The only exceptions shall be for certain special days of activities which are declared exempt by the school principal.

A. Standards for students:

1. Hair shall be neat, clean and well groomed. The coloring of hair with unnatural looking colors to include costume spray will not be tolerated. Boys will be expected to be clean shaven, although a well trimmed mustache may be worn.

2. Clothing shall be modest, neat, clean, in good repair and shall include shoes. Clothing and/or jewelry shall not be worn which displays obscene or suggestive words or pictures or which advertises any substance which a student cannot legally possess or sue. Jewelry shall not be worn in any pierced body parts other that the ears. Modesty shall include covering shoulders (must have full sleeves), covering midriff and back. Short shorts, extremely short skirts or dresses (must reach the knee) tank tops, halter or crop tops, do not meet the modesty standards in our school.

3. Wearing of bandannas, chains, or any article of clothing or jewelry that may be associated with gangs or bearing any gang symbols, names, initials, insignia or anything else which signals gang affiliation and/or is worn for the purpose of signifying gang membership is not allowed.

4. Hats and caps shall not be worn during regular school hours.

B. If a student's dress or grooming interferes with the normal education process, he/she will be asked to change whatever is in question. Continual non-compliance may result in additional disciplinary action at the discretion of the administration. The school administration will be ultimately responsible for administration of the policy.

Gum, Candy, & Drinks

Candy dispensers are supplied for your convenience, but candy, gum, etc., are not to be eaten in class. Litter resulting from these machines could cause their controlled use or elimination. Canned pop, drink containers, gum, etc., will not be allowed in the school. GENERAL RULE: "If you can buy it in the halls you can eat it in the halls."

Lunch

Students are encouraged to eat lunch in the cafeteria. During good weather students will go outside after eating until the warning bell rings for the next class. According to Nebo School District Closed Campus Policy, students are not to leave the school grounds during their lunch period. Anything purchased from the lunch program needs to be eaten in the cafeteria.

Medication-Student

All medications administered to students must follow Nebo School District Policy #JHCD and be disbursed through the school office.

Teaching the Homebound

If the student is to be out as a result of illness or injury for two (2) weeks or more, the parent may request a homebound teacher. You may request a homebound teacher by calling the school and asking for a counselor. The teacher will come to the home after clearance from the school.

Telephone

Office phones are for emergency use only and will NOT be available after school.

Report Cards

Report cards will be issued four times during the school year, at approximately nine (9) week intervals. Letter grades will be used. Midterm grades will also be issued to imform parents of student progress at midterm. Deficiency notices will be sent when necessary. At any time during the school year, a parent may a request conference with a teacher. Parents are welcome to visit the school at any time. To ensure student safety, all patrons must check in at the office upon entering the school. We would prefer classroom visits be by appointment so that the teachers will be free to meet with the parents.

Parent-Teacher Conferences

Parents are encouraged to confer with teachers concerning academic or citizenship problems that their students may be having. Teachers are available during their preparation periods or immediately before and after school. Parents should call the school to arrange for a conference. The school telephone number is 465-6040.

Parking Lots

Parking lots are out-of-bounds to the students. There will be no playing in the parking lot. Playing of games which involve throwing a ball or another object should be far enough away so that the object thrown does not hit cars or rolls into the parking lot.

Visitors

No unauthorized person is to be on the school grounds during the school day without first having been cleared with the main office and receiving the required visitor badge.

Lagoon Eligibility

Students planning on attending the school sponsored trip to Lagoon at the close of the year must meet the following requirements:

1. Citizenship- Not have any 'U's' either third or fourth terms.

2. Attendance- Must attend school on time at least 80% of the time with no more than twelve (12) recorded tardies or absences per period third term.

3. Detentions- Must have all detentions served.

4. Passing Grades- Must have all passing grades the week before Lagoon.

5. School/lunch charges- Must be paid up to date.

6. Media Center charges-Must be paid up to date.

Evacuation Procedures

Each classroom has an evacuation map hanging by the door. Please become familiar with the exit route from each of your classes. Also, there will be drills periodically in the various types of emergency situations. During these drills and/or real situations, the students are to remain calm, quiet, and follow the directions given. Students are not to be dismissed from school without administrative approval and notification of parent/guardian.

Safe School Environment Policy

A student may be suspended, expelled or Board released from school when the Administration has determined that he/she represents a threat to the health and/or safety of other students and/or employees.

Sexual Harassment Policy

The Nebo Schol District is committed to providing a work and educational environment that is free of discrimination and unlawful harassment. The District considers it unlawful discriminatory practice for an employer, because of the sex of any person, to discharge without just cause, to refuse to hire, or otherwise to discriminate against that person with respect to any matter directly or indirectly related to employment (or education). The district will consider unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature as unlawful sexual harassment. Inappropriate actions, words, pictures/media, jokes or comments based on an individuals sex will not be tolerated. That type of sexual conduct either openly manifest or subtle will be considered misconduct because it is considered demeaning to another person, invades their privacy, and undermines the integrity of the employee and/or student relationships.

The District strongly disapproves of any form of sexual harassment involving employees, students and visitors and will take preventive and corrective action against those participating in these activities.

Purpose

The purpose of the Nebo School District Sexual Harassment Policy and Procedure is to assure a learning/work environment that is free from sexual harassment and is in compliance with state and federal law.

Definition

Sexual harassment is defined as:

A. Any verbal, written, or physical conduct of a sexual nature which create an intimidating, hostile, or offensive environment.

B. Any suggestion, request, demand, or pressure for sexual involvement, accompanied by an implied or explicit threat concerning one's grades, extracurricular standing, job, etc.

C. Any unwanted sexual advance or request.

Sexual harassment includes, but is not limited to the following:

1. Derogatory, demeaning, or offensive jokes, teasing, or comments of a sexual nature.\

2. Graphic remarks or sexual comments about an individual's body.

3. Sexually suggestive or obscene telephone calls, letters, notes, or invitations.

4. Sexually suggestive or obscene pictures, cartoons, posters, or objects.

5. Grabbing, pinching, or touching of private areas.

6. Deliberate cornering, shouldering or bumping in the hallways.

7. Sexual gestures, unwanted pats, or hugs, or any unwanted touching.

8. Any form of sexual threat, intimidation, or exploitation.

9. Spreading of sexual rumors.

10. Actual or attempted sexual assault, molestation, or rape.

11. Sexist remarks or gender-based stereotyping.

12. "Pantsing" male or female students, flipping up girls' dresses, etc.

If you feel you are being sexually harassed, please talk with a teacher or administrator. Any of these infraction may also result in parent notification and/or an administrative 'N' or 'U'.

Attendance Policy (Summary)

Philosophy

School attendance has a direct impact on a student's level of academic achievement. In order to make the most of one's educational opportunity a student must have consistent, punctual, daily attendance. It is primarily the responsibility of the student to achieve daily punctual attendance as directed by the Utah Compulsory Education Act, U.C.A. 53A-11-101 et. seq. Parents or guardians and school officials share a responsibility to make earnest and persistent efforts to resolve attendance problems. A parent or guardian is always welcome and is encouraged to call or visit the school for current attendance information regarding his/her student. Parents/guardians are also encouraged to monitor student attendance by accessing the District web site on the Internet ( www.nebo.edu ).

Attendence Requirement

Students are required to attend each class, on time, every school day, unless excused.

Definitions

"Excused Absence" means a student's absent from school for the following reasons as identified by State Board of Education Policy, R227-607:

1. Illness

2. Medical/dental/orthodontic appointments

3. Family emergencies

4. Death of family member or close friend

5. Family activity

6. Student travel/activity

"Unexcused Absence" means a student's absent from school for reasons other than those authorized under this policy or an absence for which the school is not notified of the reason for the absence within two days of absence.

"Tardy" means going to a class after the tardy bell has rung. It is the responsibility of any student who is tardy to class to meet with the teacher either during or following the class period to insure that he/she was marked tardy and not absent. Tardiness is considered a disciplinary issue as well as an attendance issue. Each school, with approval of its School Community Council, may develop additional procedures for dealing with excessive tardiness.

Teacher Procedures For Handling Tardies

Each time a student is tardy, he/she must serve 30 minures of tardy detention. This may be done after school from 2:35-3:25 on Monday through Thursday in Room 235.

Procedures for Excusing An Absence

Parents/guardians must contact the school (465-6033) and provide the appropriate reasons for the absence. Notification may be by telephone or by signed note. Absences for the reasons identified above will be excused if the school is notified with TWO SCHOOL DAYS following the absence. The two day time limit, however, does not extend beyond the end of a grading period. All absences must be excused by the last day of each grading period. Parents/guardians wishing to excuse absences after the two day limit or beyond the last day of a term must submit a written letter of appeal to the local School Community Council. The school principal has authority to grant exceptions to the above in situations involving unforseen circumstances.

Checking Out of School

Any student who leaves school during the school day is required to check out at the office. He/she must present a note from the parent/guardian at the time in order for the absence to be excused. It will then be excused if it is for one of the excusable reasons. Payson Middle School is considered to be a closed campus. Students may not leave school during the school day unless they are checked out by their parent. Those students who need to leave regularly (such as going home for lunch) may obtain an on-going pass from the school administrator.

Attendance and Academic Grades

Academic grades may be impacted by attendance. At the discretion of the teacher, and upon written disclosure to students and parents, participation, attendance and punctuality may together be a factor of up to 20% of the grade given for the class. Unexcused absences and tardies would have a negative inpact on the grade. The attendance factor in grading may be greater than 20% in the following classes: band, choir, dance; orchestra and physical education.

The school shall make earnest and persistent efforts to resolve attendance problems by:

1. Monitoring the attendance of students.

2. Providing notice when a student is absent from school.

3. Notifiying parents/guardians by letter or by documented personal phone call when a student has accumulated two unexcused absences in any one period in a semester.

4. A school official will meet with parents/guardians, enlisting their support after the student has six (6) unexcused absences in a semester.

5. A truance citiation will be issued upon receiving the seventh (7th) unexcused absence.

6. A second truancy citiation will be issued when the eighth (8th) unexcused absence is received which results in a referral to CYC/Truancy school.

7. A student will be issued a third truancy citation and referred to the District Truancy Officer when he/she accumulates nine (9) unexcused absences in any one class per semester. These students will be considered "habitually truant" and referred to Juvenile Court by the District Truancy Officer. Students who continue to accumulate unexcused absences after having been to Juvenile Court will be referred to the School Guidance/At Rish Committee which will determine further actions.

Due Process

A copy of the Nebo School District Attendance Policy (FILE #JED) which includes the appeals process may be picked up from the school office or accessed on the Internet ( www.nebo.edu ).

Compliance Statement

No student, classified as disabled under the provisions of the Individuals With Disabilities Education Act (IDEA), or Section 504 of the Rehabilitation Act of 1973, shall be suspended or expelled repeatedly or for an extended period of time under this policy where the misconduct is a manifestation of that student's disability.

Student Use of Tobacco, Alcohol And Other Drugs Policy

Statement of Intent

The Nebo School District Board of Education recognizes that the use, possession, distribution,or sale of tobacco, alcohol, drugs, and/or other similarly harmful substances, or drug paraphernalia constitutes a hazard to the welfare of students and faculty, and is illegal under the laws of the State of Utah. It is the Board's responsibility to adopt policies and procedures which will minimize the hazard casued by the presence of these substances or devices in the schools or at any school sponsored functions.

The Board believes that tobacco, alcohol and drug primary prevention programs are effective in providing students with the opportunity to build social skills and enhance self-concepts, as well as providing information on the harmful effects of tobacco, alcohol and drugs. Prevention curricula can assist students with the necessary skills needed for decision making toward a more healthy life style, including the prevention of misuse and abuse of tobacco, alcohol and other drugs.

The Board supports programs that coordinate school and parent cooperation in attempting to prevent problems of drug abuse and supports programs that assist parents in seeking outside professional help from public or private educational and rehabilitiative programs.

Statement of Alcohol and Drug Policy

Nebo School District prohibits any unauthorized student use, possession, sale or distribution of alcohol, controlled substances, imitation controlled substances, and/or other similarly harmful substances, or drug paraphernalia. These actions are prohibited in any school building, or on any other property owned or operated by the District, or at any school sponsored activity, or in any vehicle dispatched by the District to transport students to or from an activity. These prohibitions apply whether or not the actions occur during regular school hours.

Definitions

The words "use, "possession," "sale," "distribution," "alcohol," "drugs," controlled substances," and "imitation controlled substances," shall have the meanings ascribed to them in the Utah Controlled Substances Act, the Utah Drug Paraphernalia Act, the Imitation Controlled Substances Act, and the Alcoholic Beverage Control Act, or any successor acts thereto of the Utah Code. The word "parents" means natural parents, foster parents, or legal guardians. The words "other similarly harmful substances" means substances such as inhalants and/or inappropriate use of prescription or over-the-counter drugs.

Disciplinary Action For Violation of Alcohol and Drug Policy: Use or Possession

Disciplinary action, independent of any court action, will be taken by the School District in cases involving the illegal use or possession of alcohol, controlled substances, imitation controlled substances, and/or other similarly harmful substances, or possession of drug paraphernalia. Students will be subject to immediate suspension or possible expulsion for violation of the policy.

Any disciplinary action will follow the Nebo School District's due process procedures for students.

First Violation of Alcohol and Drug Policy: Use or Possession

Procedures:

A student shall be suspended from school for up to ten days.

The principal or designee, during the suspension period, shall:

a. notify the parents;

b. shall notify the appropriate law enforcement agency and provide the agency with all confiscated evidence and information;

c. schedule a parent conference during the suspension period; and

d. refer the student and parent to the Risk Alternative Program.

The student:

a. shall sign a non-use contract with the parent and principal designee;

b. shall reveal source of material associated with this violation;

c. complete the district Risk Alternative Program; and

d. shall not participate in school-sponsored activities until any suspension has been removed.

Failure of the student to comply with any of the above will result in referral to the Board for expulsion as outlined under procedures for those involved in a second violation.

Second Violation of Alcohol and Drug Policy: Use or Possession

Procedures:

A student will be suspended from school and referred to the Board for expulsion for 90 school days.

The principal or designee:

a. shall notify the parents;

b. shall notify the appropriate law enforcement agency and provide the agency with all confiscated evident and information; and

c. follow the District suspension guidelines and refer the student and parent to a second Risk Alternative Program.

The student:

a. shall meet with the school counselor and explore educational options available during the expulsion period; and

b. shall not participate in school sponsored activities until he/she has been reinstated by the Board; or

c. shall complete, along with the parent, the Risk Alternative Program a second time.

Reinstatement:

If the student desires to return to school before the 90 day suspension is completed, the only option is to complete the Risk Alternative Program a second time in a satisfactory manner.

If a student desires to return to school after 90 days, he/she must petition the Board and show evidence that he/she has done the following:

a. the student shall participate in a formal alcohol and/or drug assessment with the cost of the assessment assumed by the parent. (For no-cost options, check with the school counselor);

b. the student will show evidence of having completed a treatment

c. program with a licensed individual or agency with the cost of the alternative treatment program assumed by the parent. (For no-cost options, check with the counselor); and

d. the student shall show evidence that he/she has revealed source of material associated with the violation.

Third Violation of Alcohol and Drug Policy: Use or Possession

Procedure:

The student shall be referred to the Board for permanent expulsion from school.

The principal or designee:

a. shall notify the parents; and

b. shall notify the appropriate law enforcement agency and provide the agency with all conficated evidence and information.

First Violation of Alcohol and Drug Policy: Sale or Distribution

Procedures:

A student will be suspended from school and referred to the Board for expulsion for 90 school days.

The principal or designee:

a. shall notify the parents; and

b. shall notify the appropriate law enforcement agency and provide the agency with all confiscated evidence and information.information.

The student:

a. shall meet with the school counselor and explore educational options available during the expulsion period; and

b. shall not participate in school sponsored activities until he/she has been reinstated by the Board.

Reinstatement:

If a student desires to return to school after 90 school days, he/she must petition the Board and show evidence that he/she has done the following:

a. the student shall participate in a formal alcohol and/or drug assessment with the cost of the assessment assumed by the parent. (For no-cost options, check with the school counselor);

b. the student shall show evidence of having completed a treatment program with a licensed individual or agency with the cost of the alternative treatment program assumed by the parent. (For no-cost options, check with the school counselor); and

c. the student shall show evidence that he/she has revealed the source of materials associate with the violation.

Second Violation of Alcohol and Drug Policy: Sale or Distribution

Procedure:

The student shall be referred to the Board for permanent expulsion from school.

The principal or designee:

a. shall notify the parents; and

b. shall notify the appropriate law enforcement agency and provide the agency with all confiscated evidence and information.

Records of Violations

Policy violations are cumulative grades K-12. The records of clearly substantiated violations of this policy noting date, type of violation, and disciplinary action taken will be kept at the local school in the student's record. Previous record of violations concerning tobacco, alcohol and/or drug policies from previous schools will be taken into account before transferring student is officially enrolled in Nebo School District.

Statement of Tobacco Policy

Nebo School District prohibits any unauthorized student use, possession, sale or distribution of tobacco/tobacco products. These actions are prohibited in any school building, or on any other property owned or operated by the District, or at any school sponsored activity, or in any vehicle dispatched by the District to transport students to or from an activity. These prohibitions apply whether or not the actions occur during regular school hours.

Definitions

The word "tobacco" shall include cigarettes, cigars, pipes, smokeless, or other tobacco products in any form. The word "parents" means natural parents, forster parents or legal guardians.

Disciplinary Action For Violation of Tobacco Policy:

Disciplinary action, independent of any court action, will be taken by the School District in cases involving the use, prossession, sale or distribution of tobacco/tobacco products. Students will be subject to suspension, or possible expulsion for violation of this policy.

First Violation of the Tobacco Policy

Procedures:

The principal or designee shall:

a. notify the parents;

b. submit a court referral; and

c. schedule a parent conference.

The student shall sign a non-use contract with the parent and principal or designee. Failure of the student to sign the non-use contract will result in suspension as outlined under procedures for "Second Violation of the Tobacco Policy."

Second Violation of the Tobacco Policy

Procedures:

A student shall be suspended from school for up to ten days. The principal or designee, during the suspension, shall:

a. notify the parents;

b. submit a court referral;

c. schedule a parent conference during the suspension period; and

d. refer the student to the Tobacco Cessation Program.

The student shall:

a. sign a non-use contract with the parent and principal or designee; and

b. not participate in school sponsored activities until the suspension has been removed;

c. successfully complete the Tobacco Cessation Program.

Failure of the student to comply with any of the above will result in referral to the Board for explusion as outlined under procedures for those involved in a third violation.

Third Violation of the Tobacco Policy

Procedure:

A student shall be suspended from school and referred to the Board for explusion for 90 school days.

The principal or designee shall:

a. notify the parents;

b. submit a court referral; and

c. refer student to the Tobacco Cessation Program a second time; Parent involvement mandatory.

The student shall:

a. meet with the school counselor and explore educational options available during the expulsion period; and

b. not participate in school sponsored activities until he/she has been reinstated by the Board;

c. successfully complete the Tobacco Cessation Program a second time.

Reinstatement:

If the student desires to return to school before the 90 day suspension is complete, the only option is to complete the Tobacco Cessation Program a second time in a satisfactory manner.

If a student desires to return to school after 90 school days, he/she must petition the Board and show evidence of having completed a tobacco cessaiton program with the cost of the program assumed by the parent. (For no-cost options, see addendum.)

The student shall be referred to the Board for permanent expulsion from school.

The principal or designee shall:

a. notify the parents; and

b. submit a court referral.

Student Self-Referral

If a student is self-referred concerning a tobacco, alcohol or drug problem, the District will provide a conference with the school Designated Educator and/or the school intervention team staff to discuss possible resources for assistance.

Addendum

For chemical dependent assessment evaluations, outpatient counseling, inpatient/residential treatment and other therapeutic sevices, please talk to the counselor at the school. The counselor will have a complete list of places where services are offered along with the cost for those services. Any disciplinary action will follow the District's due process procedures for students.
